Terms of Service

1. Definitions

• The Extension, the open-source Karafilt browser extension, released under the MIT License.
• The Service, the hosted offering we operate: the karafilt.com account site, which lets you create and manage a free account.
• We / us, Betania.io, the business registered in Serbia that operates the Service. (The open-source Extension also takes contributions from the wider community; these Terms cover the hosted Service, not the open-source code.)
• You, the user of the Extension or the Service.

2. Open-source license

The Extension is free software released under the MIT License. You may use, modify, and redistribute it under the terms of that license. Nothing in these Terms restricts your rights under that license with respect to the software itself; these Terms govern your use of our hosted Service.

3. Accounts

• You must be at least 16 years old to create an account.
• Provide accurate information, verify your email, and keep your credentials secure.
• You are responsible for activity under your account.
• One account per person. Don't share an account.
• Karafilt is free, but an account is required to use the extension so we can keep track of our users. You can delete your account at any time from your account page.

4. Acceptable use

You agree not to:

• Use Karafilt for any activity that violates copyright or applicable law. Karafilt processes audio transiently in your browser for your personal listening; you are responsible for the audio you process and for complying with the terms of the sites you play it from.
• Attempt to probe, overload, or compromise the Service's infrastructure (the software itself is open source, read it all you like).
• Create accounts in an automated or abusive way, or otherwise interfere with other users' access.
• Use Karafilt to identify, harass, or stalk anyone.

5. Suspension and termination

We may suspend or revoke access to the Service for clear abuse or violation of these Terms. We'll notify you by email when reasonably possible. You may close your account at any time from the account page; we'll delete your personal data within 30 days except where law requires retention. Suspension of the Service never affects your rights to the open-source software.

6. Disclaimers

THE EXTENSION AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or perfectly accurate.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO FIFTY US DOLLARS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your misuse of the Service or violation of these Terms, including reasonable legal fees.

9. Copyright (DMCA)

Karafilt does not host or store processed audio. If you nevertheless believe activity via Karafilt infringes your copyright, send a notice to hello@betania.io with the information required by 17 U.S.C. § 512(c)(3). We'll respond within 14 days.

10. Changes

We may update these Terms. Material changes will be announced by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of Serbia.

12. Entire agreement

These Terms (together with the Privacy Policy and, for the software, the MIT License) are the entire agreement between you and us. If any provision is held unenforceable, the rest remains in effect.
